Juneau’s Secondhand Smoke Control Code
Enforcement
Business owners are responsible for enforcement of the Secondhand Smoke Control Code (CBJ 36.60.00) on their property. If a person insists upon smoking after being asked to stop, anyone can call the Juneau Police Department at the main number – 586-0600 – to report the infraction. JPD has officers who will take the calls in priority order and respond. They will explain the law to the person and take any further action as necessary, including escorting the patron off the property if necessary.
Violation and Penalties
Smoking where prohibited is an infraction that can incur a fine of $50. If a business fails to comply with the ordinance by allowing smoking on the premises, it can result in enforcement action including citations and fines up to $300 and injunctive remedies.

Where is smoking prohibited?
Smoking is prohibited within any enclosed public place, including restaurants, bars, office buildings, malls, etc. Bus shelters are also included.

Smoking is prohibited within 10 feet of any entrance, open window, or ventilation intake of any enclosed public space.

The owner, operator, manager, or other person having control of an enclosed public place must clearly post a sign at the entrance indicating that smoking is prohibited inside.

The owner, operator, manager, or other person having control of any area where smoking is prohibited must remove all ashtrays from the premises.
